Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Trackly (trackly-app.com), provided by Trackly, registered as a self-employed individual (autonomo) in Spain (“we”, “us”, or “Trackly”).

By using the service, you agree to these Terms. If you do not agree, please do not use the service.

1. Introduction

These Terms of Service (“Terms”) govern your access to and use of Trackly (trackly-app.com), provided by Trackly, registered as a self-employed individual (autonomo) in Spain (“we”, “us”, or “Trackly”).

2. Description of Service

Trackly is a web application for tracking personal metrics over time and analysing correlations between them. The service allows you to:

  • create trackers for any measurable data point;
  • log values manually and visualise trends through charts;
  • discover correlations between different metrics;
  • share public data entry forms with others.

Trackly is not a medical device, does not provide diagnoses, and does not offer medical advice. See Section 11 for details.

3. Beta Version

The current version of the service is a beta. This means:

  • the service is provided “as is” and may contain bugs;
  • features may change without prior notice;
  • we do not guarantee uninterrupted availability;
  • your data may be reset or deleted during technical maintenance — although we make every effort to avoid this.

We will notify you when the beta period ends.

4. Registration and Account

4.1. Using Trackly requires registration. You agree to provide accurate information and keep it up to date.

4.2. Minimum age. Trackly is available only to individuals aged 16 or older. By registering, you confirm that you meet this requirement. If we become aware that an account belongs to a person under 16, we will delete it along with all associated data.

4.3. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.

4.4. If you suspect unauthorised access to your account, notify us immediately at support@trackly-app.com.

4.5. One person, one account. Transferring your account to another person is not permitted.

5. Acceptable Use

By using Trackly, you agree not to:

  • violate any applicable law or the rights of third parties;
  • upload or transmit malware, spam, or unlawful content;
  • attempt to gain unauthorised access to our systems or the data of other users;
  • scrape or automatically collect data from the service without our written permission;
  • use the service to store or transmit confidential medical data of third parties without their explicit consent;
  • resell or commercially exploit the service without a separate agreement with us.

6. Your Data

6.1. You retain full ownership of all data you enter into Trackly.

6.2. By using the service, you grant Trackly a limited licence to store and process your data solely for the purpose of providing the service.

6.3. We do not sell your data to third parties. How we collect, use, and retain your personal data — and your rights regarding it — are described in our Privacy Policy.

6.4. When you delete your account, your data is removed from our active database immediately upon confirmation. Automated backups are purged within 30 days, after which your data is permanently gone. See Section 7 of our Privacy Policy for details.

7. Intellectual Property

7.1. All rights in the Trackly service — including its source code, design, logo, trademarks, algorithms, and content — belong to Trackly. These Terms do not transfer any intellectual property rights to you, other than the limited right to use the service as described herein.

7.2. You retain full ownership of the data you enter into the service. Trackly makes no claim of ownership over your content.

7.3. The name “Trackly”, its logo, and related marks are trademarks or designations of Trackly. Use of these without our written permission is prohibited.

8. Feedback and Suggestions

If you send us feedback, ideas, feature suggestions, or bug reports (collectively, “Feedback”), you grant Trackly an irrevocable, non-exclusive, royalty-free right to use, reproduce, and incorporate that Feedback into the service without any compensation or obligation to you. We value your input, but cannot commit to implementing specific ideas.

9. Third-Party Services

Trackly relies on third-party infrastructure and service providers (including Supabase, Vercel, and PostHog). We are not responsible for outages, disruptions, or changes in the terms of these providers that may affect Trackly's availability. The current list of providers and data processing details are described in our Privacy Policy.

10. Public Data Entry Forms

10.1. Trackly allows you to create public entry forms (/form/[slug]) accessible without a login. If you share such a form and third parties submit their data through it, you are responsible for ensuring you have their consent to collect and transmit that data.

10.2. You may not use public forms to collect data you are not legally entitled to collect, including personal or medical data of third parties without their explicit permission.

10.3. Trackly acts as a data processor with respect to information submitted through public forms. Responsibility for the lawfulness of that collection rests with the form owner.

11. Medical Disclaimer

Trackly is a personal tracking tool, not a medical device or medical software.

  • Trackly does not replace consultation with a doctor or healthcare professional.
  • Nothing in the service constitutes medical advice.
  • If you use Trackly to monitor your health, please discuss the data you collect with your doctor.
  • You are solely responsible for any decisions made based on data in Trackly.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Trackly is provided “as is”, without warranties of any kind, express or implied;
  • we are not liable for indirect damages, data loss, or lost profits;
  • our total liability to you shall not exceed the amount you paid for the service in the preceding 12 months (or €10 if you used the service for free).

13. Termination

13.1. You may delete your account at any time via Settings → General → Delete my account, or by contacting us at support@trackly-app.com.

13.2. We reserve the right to suspend or terminate your access to the service without prior notice if:

  • you violate these Terms;
  • your actions pose a risk to the security of the system or other users;
  • required by applicable law.

13.3. We may discontinue the service entirely by giving you 30 days' notice.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of any material changes by email no later than 14 days before they take effect. Continued use of the service after the updated Terms take effect constitutes your acceptance of the changes.

15. General Provisions

Governing law. These Terms are governed by the laws of Spain and the European Union, including the GDPR. If you are a consumer in an EU member state, you also benefit from the mandatory protections provided by the laws of your country. Disputes that cannot be resolved amicably are subject to the jurisdiction of the courts of Spain, unless applicable law requires otherwise.

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Trackly regarding the use of the service and supersede any prior understandings.

Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

No waiver. Our failure to enforce any provision of these Terms on a given occasion does not waive our right to enforce it in the future.

Assignment. You may not transfer your rights under these Terms to any third party without our written consent. Trackly may transfer its rights and obligations (for example, in the event of a restructuring or acquisition) upon notice to you.

Notices. Official notices from Trackly will be sent to the email address associated with your account. Notices to us should be sent to support@trackly-app.com.

16. Billing and Subscriptions

16.1. Plans.Trackly offers a Free plan, at no cost and subject to the usage limits shown on our pricing page, and a paid “Plus” plan, billed either monthly or annually as selected at checkout. Current prices are shown at checkout and on our pricing page and include applicable tax.

16.2. Payment processing. All payments are processed by Stripe, our third-party payment processor. Trackly does not store your full card details. See our Privacy Policy for details on the data shared with Stripe.

16.3. Immediate start of service. By subscribing to Plus, you expressly request that we begin providing the paid service to you immediately, before the end of the statutory withdrawal period described in Section 16.4.

16.4. EU 14-day right of withdrawal — waiver. If you are a consumer resident in the European Union, you generally have a 14-day right to withdraw from a distance contract without giving a reason. Because Trackly is a digital service that begins performance as soon as your subscription is activated, by checking the consent box at checkout you acknowledge that performance has begun with your prior express consent, and you expressly waive your right of withdrawal once the service has started. After service has begun, you are not entitled to a refund of your subscription fee under the withdrawal right, except as described in Section 16.7.

16.5. Auto-renewal. Subscriptions renew automatically for successive periods matching your billing cycle (monthly or annual) unless canceled before the renewal date. We will attempt to charge the payment method on file at each renewal.

16.6. Cancellation. You may cancel your subscription at any time from Settings → Billing. Cancellation takes effect at the end of your current paid billing period — you retain Plus access until then, with no partial-period refund. If, once your Plus access ends, you have more boards than the Free plan permits, your newest boards beyond the Free-plan limit will be locked for editing (not deleted); your data is never deleted as a result of downgrading.

16.7. Refunds. Refunds are not automatic and are granted at our discretion on a case-by-case basis. To request one, contact support@trackly-app.com.

16.8. Failed payments. If a renewal payment fails, we (via Stripe) may retry the charge automatically. If payment continues to fail, your subscription may be canceled and your account downgraded to the Free plan, subject to the same board-locking rule described in Section 16.6.

16.9. Price changes. We may change subscription prices for future billing periods. We will notify existing subscribers at least 30 days before any price increase takes effect; continued use of Plus after that date constitutes acceptance of the new price.

16.10. Account deletion with an active subscription. If you delete your account while an active Plus subscription exists, you must first cancel your subscription. Deleting your account cancels the subscription immediately, not at the end of the billing period, and no refund is issued for the unused portion of the period unless applicable law requires otherwise.
